Data Privacy Notice for Mexican Residents

Pursuant to the Mexican Federal Law for the Protection of Personal Data in Possession of Private Parties (Ley Federal de Protección de Datos Personales en Posesión de Particulares herein after referred to as the “Law”), Marco’s Franchising, LLC (the “Data Controller” or “Marco’s Pizza”), with domicile at Av.Ejercito Nacional 843-B, Corporativo Antara I, piso 12, Alcaldía Miguel Hidalgo, Código postal 11520, Ciudad de México and web page: https://www.marcos.com, Marco’s Pizza is the responsible of the processing and protection of your personal data in accordance with the Law. As consequence, please be informed of the following:

What will we use your personal data for?

The personal data we obtain from you, will be used for the following purposes that are necessary for the service you request:

Handle food requests and orders in the establishment.
Perform the payments and invoicing of the services and products purchase.
Provide security for visitors of the Data Controller’s restaurant or physical establishment.
To contact the customer in relation to food preparation services, as well as to carry out deliveries of the products.
User account creation and management.
Verify the identity and validate the veracity and quality of the information provided by the client.
Avoid allergies or contact with food and non-preferable processes in the product you’ve purchased.
Bank clarifications.
To handle requests for the exercise of ARCO rights (as such terms are defined below).

In addition, we will use your personal information for the following secondary purposes that are not necessary for the requested service, but that allow and facilitate us to provide you with better service:

a. To perform statistical and market analysis or studies.
b. To improve customer satisfaction and address complaints, questions or suggestions.
c. To carry out delivery of advertising material of the Responsible.
d. Providing food preparation services based on customer preferences.
e. Deliver or perform marketing or advertising.
f. Commercial prospecting.

The refusal to use your personal data for these purposes shall not be a reason for us to deny you the services and products you request or contract with us.

What personal data will we use for these purposes?

To carry out the purposes described in this privacy notice, we will use the following personal data:

– Name
– Federal Taxpayer Registry
– Date of birth
– Domicile
– Private phone
– Cellular phone
– E-mail
– Autograph signature
– Electronic signature
– Age
– Video surveillance photography or images
– Tax information
– Credit or debit card numbers
– Data about preferences and interests regarding products commercialized by the Data Controller.
– Additional data requested with the purpose to handle complaints, questions, claims or information requests.

In addition to the personal data mentioned above, for the purposes informed in this privacy notice, we will use the following personal data considered as sensitive, and as consequence it requires special protection:

– Data concerning health, in particular allergies or preferences to the exclusion of substances or components used in the preparation of the Data Controller’s products.

With whom do we transfer your data?

Marco’s Pizza, as the case may be, will transfer certain personal data to third-party service providers in Mexico or the United States of America for the purpose of analyzing customer information and implementing strategies to optimize the service we provide. Such third parties will be bound to the obligations set forth in this Privacy Notice as if they were the Data Controllers.

How can you access, rectify or cancel your personal data or object to its use?

You have the right to know what personal data we have about you, what we use it for, and the conditions of the use we make of it (Right of Access). Likewise, it is your right to request the correction of your personal data, in the event it is outdated, inaccurate or incomplete (Right of Rectification), or to be removed from our records or databases if you consider its use inadequate (Right of Cancellation). Additionally, you can oppose to the use of your personal data for specific purposes and even limit its processing and disclosure (Right of Opposition). These rights are known as ARCO rights.

To exercise any of the ARCO rights, you must submit the respective request by e-mail to datainquiry@marcos.com, or through written request addressed to the offices located at Av. Ejercito Nacional 843-B, Corporativo Antara I, piso 12, Alcaldía Miguel Hidalgo, código postal 11520, Ciudad de México for the attention of the Personal Data Protection Department.

Regarding the procedure and requirements for the exercise of your ARCO rights, we inform you the following:

You must prove sufficient capacity through the submission of a copy of your official ID, and if you are a acting on behalf of a third party or legal entity, you must submit a proxy letter, or a power of attorney duly notarized before a notary public.
The request must be signed by handwritten signature or by electronic signature and contain the following: (i) name of the data subject, (ii) address and e-mail address to receive your response, (iii) a clear and precise description of the data with respect to which you seek to exercise any ARCO right, as well as the justification for the exercise of such right, and (iv) any information that that could ease its search.
The Data Controller will provide a response within 20 business days through the mean you request.

Through the same procedure, you may revoke the consent you have given to us for the processing of your personal data, if any. However, it is important to note that not in all cases we will be able to meet your request or terminate the use immediately, since it could be possible that we require to continue the processing of such data due to certain obligation arising from the contractual relationship or by law. You should consider as well that for certain purposes, your consent revocation will mean that we can no longer provide the service you requested, and as consequence, the relationship with the Data Controller will be terminated.

In the event you believe that your rights for the protection of Personal Data have been infringed upon due to improper handling by Marco’s Pizza and/or its processors, you may file a complaint or report with the National Institute of Transparency, Access to Information, and Protection of Personal Data (“INAI”). How do we store your information?

Marco’s Pizza will store and process data according to the strictest confidentiality standards based on the principles and duties established by the INAI, as well as the Law.

Cookies and web page tracking

We inform you that on our website we use cookies, web beacons or other technologies, through which it is possible to monitor your behavior as an Internet user, as well as to provide you with a better service and experience when browsing our website. The personal data we collect through these technologies will be used for the following purposes:

– Statistical and marketing purposes.
– Improving the user experience of the website.

The personal data obtained through this tracking are:

– Region in which the user is located.
– Type of user’s browser.
– Type of user’s operating system.
– Date and time of the start and end of a user’s session.
